Yapı denetim sisteminde yaşanan sorunlar, 4708 sayılı Yapı Denetim Hakkında Kanun'daki eksiklikler ve çözüm önerileri

Abstract

Can ve mal güvenliğini teminen, imar planına, fen, sanat ve sağlık kurallarına, standartlara uygun kaliteli yapı yapılması için, proje ve yapı denetimini sağlamak ve yapı denetimine ilişkin usul ve esasları belirlemek amacıyla 13 Temmuz 2001 tarihinde Resmi Gazete'de yayımlanarak yürürlüğe giren 4708 sayılı Yapı Denetim Hakkında Kanun kabul edilmiştir. Bu çalışmada öncelikle yapı denetim kavramı ve amacı üzerinde durulmuş, yapı denetimin tarihsel gelişimi araştırılmış ve yabancı ülkelerde uygulanan yapı denetim sistemlerine yer verilmiş, sonraki bölümde Türkiye'deki yapı denetimin gelişimi anlatılmış ve günümüzde uygulanan yapı denetim sistemi araştırılmış, sistemin işleyişinde karşılaşılan sorunlar incelenmiş ve sorunların çözümü için çözüm önerileri getirilmeye çalışılmıştır. Bu amaçla İstanbul'da faaliyet gösteren yapı denetim firmalarının sorunlara bakış açılarını belirlemek amacıyla anket çalışması yapılmıştır. Yapılan çalışmada ortaya çıkan sonuç yapı denetim sisteminin ülkemizde sağlıklı olarak yürütülmediğini göstermiştir. Yapı denetimde rol alan bütün tarafların üzerine düşen görevi eksiksiz yapması gereği ortadadır. Bu çerçevede ilgili Bakanlık bazı düzenlemelere gitmiş ancak yapılan düzenlemelerin sorunların çözümü için yeterli olmadığı görülmüştür.

Providing the security of vitality and goods, at 13 July 2001 4708 numbered Law About The construction audit has been accept to built good quality constructions that are suitable for public improvements, science, art and health rules and standards. In this research, firstly, has been done to dwell upon construction audit concept and the aim of construction audit. The historical development of construction audit has been researched and mentioned about audit systems that applied in developed countries. The following chapter explains the development process of structure audit system in Turkey. And applied system has been researched. The study has been done to identify the issues and problems coming up against the construction audit firms, and to try to find out solutions for them. In this research, a questionnaire has been conducted among construction audit firms in Istanbul to identify the matters and to find out their approach and evaluations. The research shown that the construction audit system has not been applied healthy in our country. All the parts of construction audit system must fulfill responsibilities. So the concerned ministry performed some arrangements, but these arrangements have not been enough for the solution of problems.
