İnşaat sözleşmeleri ve yüklenici seçim kriterleri

Abstract

Bu çalışmada, Türkiye Kamu İhale Kanunu, inşaat sözleşmeleri ve yüklenici seçim kriterleri açısından incelenmiştir. Türkiye Kamu İhale Kanunu yüklenici seçim kriterleri açısından diğer 13 ülke ile kıyaslanmıştır. Bu 14 ülkenin kıyaslanması sonucunda ülkelerin yüklenici değerlendirme kriterlerini gösteren tablo oluşturulmuştur. Yüklenici seçimi için kullanılacak kriterler belirlenmiş ve bu kriterlerin sıralamasının yapılması amacıyla yüklenici seçim kriterleri puanlama anketi oluşturulmuştur. Bu anket konuyla ilgili uzmanlara ve işverenlere gönderilmiştir. Yeterli sayıda katılımcı tarafından doldurulan anketler sonucunda elde edilen veriler analiz edilmiştir ve kriterlerin önem sırası ortaya çıkarılmıştır. Sonuç olarak yüklenici değerlendirmesi için bir form oluşturulmuştur. Bu form literatürdeki benzer çalışmalarla karşılaştırılmış ve literatür çalışmalarına yakın sonuçlar verdiği görülmüştür. Bu form çok geniş kapsamlı ve kompleks olduğundan dolayı küçük çaplı ve basit projelerde uygulanabilecek yüklenici değerlendirme özet formu oluşturulmuştur. Bunların yanında, literatür çalışmalarından ve ülkelerin yüklenici değerlendirmesi için hazırladıkları formlardan örnek teşkil edebilecek olanları Türkçeye çevrilerek sunulmuştur.

In this study, Public Procurement Law of Turkey has been studied for construction contracts and contractor selection criterias. Public Procurement Law of Turkey has been compared with the other 13 countries Public Procurement Laws in terms of contractor selection criterias. Following the comparison of these 14 countries the table that showing the contractor selection criterias of countries has been established. For the contractor selection, the criterias that going to be employed were determined than scoring questionnaire has been developed for the ranking of these criterias. This questionnaire has been delivered to the clients and experts who have an experience on this subject. Questionnaires have been obtained from sufficient number of participants were analyzed and then relative importance of criterias have been found out. As a result, a form was developed for contractor evaluation. This form was compared with similar studies can be found in the literature and it was observed that it gives comparable results with them. Due to the complexity and comprehensive of this form, contractor evaluation summary form has been developed to perform in small scaled and simple projects. Furthermore, literature studies and forms created by other countries for contractor selection has been translated into Turkish and presented to serve as an example.
