Bunlardan en yaygın olanı “Tapu Sigortası” kavramıdır. Tapu sigortası kişinin bina, arazi gibi taşınmazlar üzerinde tasarrufta bulunabilme imkanı sağlayan yasal hakka veya yasal hakkın devrine ilişkin bir kusur veya eksiklik nedeniyle, uğrayabileceği mali kayıpları ve başkalarına karşı sorumluluklarını, poliçe kapsamındaki şartlar ve sınırlar dahilinde tazmin eden sigorta şeklidir. Tapu sigortası kavramı ilk kez Amerika Birleşik Devletleri’nde ortaya çıkmıştır. Avrupa’da ise yasal süreç ve mevcut sorunlar gelişmiş ülkeler ve gelişmekte olan ülkelerde birbirinden farklıdır. Tapu sigortasının Türkiye’de uygulanabilirliği açısından bakılarak ülkemizdeki mevcut yasalar ve uygulamaları ele alınmıştır. Avrupa İnsan Hakları Mahkemesi’nde görülmüş ve mahkemece Türkiye’ye açılan davalardan 2005 – 2010 yılları arasında karara bağlanmış olanları incelenmiştir. Ülke sınırları içerisinde faaliyet gösteren tek bir tapu sigorta şirketi olduğu tespit edilmiş ve bu şirket yapısal ve faaliyet alanları yönünden incelenmiştir. Türkiye’deki sadece bir adet taşınmaz projesinde tapu sigortasının uygulandığı görülmüştür. Taşınmaz projesi konumu, yatırımcıları ve projenin içeriği yönünden incelenerek neden tapu sigortası ürününü tercih ettikleri ortaya konmuştur. Halihazırdaki yasal durum, Türkiye’deki tapu sigortası pratik uygulama, bankalar, yatırımcılar ve sigorta şirketleri açılarından bakılarak tapu sigortasının Türkiye’de uygulanabilirliğinin güçlü ve zayıf yönleri ortaya çıkartılmış ve uygulanabilirliği test edilmiştir.University : Istanbul Technical University Institute : Institute of Science and Technology Science Programme : Real Estate Development Programme : Real Estate Develepment Supervisor : Doç. The most common of these is the concept of Title Insurance . It provides to guarantee an individual’s rights of owning a real estate property and it protects the individual from the problems that may occur at the stage of transfer under the coverage of the policy. Title insurance has first arose in United States of America. The legal process and the existing problems are different in the developed countries from the ones in the developing countries within Europe. The applicability of title insurance in Turkey is being argued by firstly examining the existing laws and their enforcements in the country. The cases, have consulted to European Court of Human Rights in order to compensate the losses and the cases that are eventuated between 2005-2010 against Turkey have been studied. The research showed that there is only one title insurance company within the borders of the country and this company has been studied on our part. In Turkey, there is only one real estate project that includes title insurance. The location of the project, investors and the content of the project has been studied in the ways of its, why title insurance has been preferred is being questioned. From the perspectives of the legal situation at present, the practical application of title insurance in Turkey, banks, investors and insurance companies, the applicability of title insurance in Turkey has been discussed with its weak and strong point.
