Kırsal Ve Kentsel Yerleşim Alanlarındaki Dere Yataklarının Islahında Öne Çıkan İdari, Teknik Ve Çevresel Sorunlar.

Abstract

Bu çalışmada; kırsal ve kentsel yerleşim alanlarındaki dere yataklarının ıslahında karşılaşılan birçok sorun irdelenmiştir. Bu sorunlar ayrı ayrı sınıflandırılmış, uygulama ve işletme sorunlarından bahsedilmiştir. Mevcut durum titizlikle incelenmiş, gerek teknik açıdan gerekse de yasal mevzuat açısından değerlendirmeler yapılmıştır. Dere yatakları yasal olarak devletin malıdır. Bu husus yasalarla belirtilmiştir. Dere yatakları hakkında hüküm ve tasarrufta bulunma devletin hakkıdır. Çalışmada yürürlükte olan birçok kanun, yönetmelik vb. incelenmiş ve bu dere yataklarının mülkiyeti konusunu sorun haline getiren kanunlar tespit edilmiştir. Örneğin birkaç yasada dere yataklarının mülkiyetinin devlete ait olduğu ve tasarrufun onun elinin altında olduğundan bahsedilirken, diğer birkaç yasada bu tasarrufun özel mülkiyete geçebileceğinden bahsedilmektedir. Bu çarpıklık dere yataklarının kullanımındaki sorunları beraberinde getiren başlangıç noktasıdır. Yerleşim yerlerini ve dere yataklarını belirleyen imar planlarında da sorunlar mevcuttur. İmar planları, her ne kadar ilgili kurumların görüşleri alınarak yapılıyor olsa da ıslah çalışması için bir çözüm değil sorun olabilmektedir. İmar planları bir rant aracı olarak kullanılmakta, şehirleşmeye ışık tutamamakta, adeta varolan gayrimeşru durumu meşru hale getirmektedir. Şehirlerde ve kırsal kesimlerde arazi kullanımları bir plana veya mantığa göre yapılmadığı için araziler doğru kullanılmamakta, bunun sonucu olarak da ıslahlı ve ıslahsız derelerin büyük dönüş aralıklı yağışlarda taşkınlar meydana gelmekte ve kenar yerleşim alanlarında can ve mal kayıpları meydana gelmektedir. Yukarıda özet olarak anlatılan hususlar, bu tez kapsamında ayrıntılı olarak incelenmiş, tespitlerde ve bazı önerilerde bulunulmuştur.

In this study, various featured poblems have been examined on creek reclamations in rural and urban residential areas. These problems have been classified separately and mentioned their application and operation problems. Current situation has been investigated meticulously. Appreciations have been made either from techinal aspect or legal regulations aspect. Working primarily with the subject of this study was started by defining the morphology of rivers. Described a kind of stream IDs, aimed to gain insight to the reader about their capacity. The creeks great geographical watershed, watershed dynamics, formation of creek beds and dynamics of these beds have been described. Creekbeds are legally the property of the state. This point is stated by law. On the creek bed is the right of states have provisions and savings. In the study, which valid many laws, regulations etc. have examined the issue of ownership of the creek bed, making problems with laws have been identified. The biggest mistakes made in reclamation of creek, debris and garbage disposal to the creek bed, the narrowing of the stream cross-section, made building on creekbed, uncontrolled transition of wastewater and drinking water lines, sealing over the creekbed. Other problem is the uncontrolled infrastructure discharged. While collecting data for the thesis some observation made about that issue. In cities and rural areas land use is not undertaken according to a plan or rationale for the land is not used properly. As a result of this, reclamated and unreclamated creeks in big return intermittent rainfall floods and life and property losses occur on creeks environment residential areas. Especially outside of urban centers in towns and villages, in creek beds and the countryside will be built during the selection for all the structures, the absolute requirement of the geological ground surveys should be carried out. These areas should be opened to development after the completion of infrastructure services. Another necessity of making geological ground surveys is to determine the groundwater level. The absolute level of groundwater in stream rehabilitation work must be known. The absolute knowledge, in the planning section, the creek and flood protection area bands form should be used in the determination. As a summary of the matters described above, the scope of this thesis has been examined in detail, some observations and suggestions were made.
