Türkiye’de Liman Devleti Kontrol Uygulamaları İçin Eğitim Modeli Oluşturulması

Abstract

Uzun yıllar içerisindeki dünya ticaret filosunun hızla gelişmesi deniz kirliliği, personel emniyeti gibi sorunlar doğurmuştur. Bu sorunları bertaraf edebilmek adına IMO’nun hazırladığı kurallar bulunmaktadır. Standartların uygulanıp uygulanmadığı konusu ise uzun yıllar boyunca süregelen çalışmalar sonucunda bir denetim organı tarafından denetlenmeleri gerektiği sonucunu ortaya koymuştur. Bu amaçla; Liman ve Bayrak Devleti Kontrolleri ve denetçileri organize edilmiş ve ülkeler bağımsız olarak kendi ülkelerinde bir denetim standardı oluşturma yarışına girmişlerdir. Zaman içerisinde, ülkeler arasında kuralları yorumlama ve uygulama konusunda bazı anlaşmazlıkların ortaya çıkması sonucunda, dünyanın çeşitli bölgelerinde belirli bölge adlarıyla bir araya gelen ülkeler, bazı mutabakatnamelere imza atarak bir birlikte çalışma grubu oluşturmuşlardır. Bu mutabakatnamelere taraf olan ülkeler belirli standartları aynı çerçevede uygulayacakları ve standart altı gemileri limanlarından uzak tutacakları hususlarında karşılıklı anlaşmalara varmışlardır ve idari bir yapılanma içine girmişlerdir. Bu yapılar çalışmamda detaylı olarak incelenmektedir. Mevcut uygulamalar çerçevesinde Türkiye’nin mevcut organizasyonunun ve denetçilerinin standardizasyonunun sağlanabilmesi amacı ile yürürlükte olan sistemler araştırılmış ve denetçiler için bir eğitim sistemi modeli oluşturulmuştur. Önerilen modelin geliştirilerek ve güncellenerek uygulamaya konması Türkiye’deki mevcut sistemin düzenlenmesine katkıda bulunabilecektir.

Severe increase in the world merchant fleet during last several decades has caused some severe problems as marine pollution, personnel safety impairment. In order to cope with these problems, there are rules and regulations present prepared by IMO. Inspection of the implementation of these rules and regulations has arised a new question which can be described as; “Are these all implemented or not?” which the answer is ofcourse there should be an inspection organisation in order to be sure. For this purpose, Port and Flag State Controls and Inspectors has been organised and countries has started a competition wise implementation of a series of standards in their countries only. By the time, after some conflicts between these countries on understanding and application of the present rules and regulations, major countries around the world has gathered and organised a work group in the name of specific regions which they have called temselves as the MOUs. Countries which have been a participant of the MOUs has agreed and signed some protocols stating that they will all apply specific standards with same objective and keep sub-standard tonnages away from their region. They have established an administrative structure for this purpose. These structures has been inspected with details. In order to standardise Turkey’s present organisation’s and the inspectors’ levels, present systems has been investigated and an example Training System Model has been improved. Improvement and updating of this model has a potential to organise the present system in Turkey.
