Enerji performans sözleşmelerinin Türkiye'de uygulanabilirlik analizi

Abstract

Enerji hizmet şirketlerinin gerçekleştirdiği projelerde müşteri tarafındaki riskin azaltılması ve finansman sağlama zorluklarının mümkün olduğunca üstesinden gelinerek enerji verimliliği projelerinin yaygınlaştırılması ve büyük boyutlu projelerin teşvik edilmesi adına atılmış önemli adımlardan birisi, bu tez çalışmasının da odak noktası olan Enerji Performans Sözleşmeleridir (EPS). Enerji performans sözleşmesi 5627 numaralı Enerji Verimliliği Kanunu'nda "Uygulama projesi sonrasında sağlanacak enerji tasarruflarının garanti edilmesi ve yapılan harcamaların uygulama sonucu oluşacak tasarruflarla ödenmesi esasına dayanan sözleşme" şeklinde tanımlanmaktadır.

Energy Performance Contracts (EPC), which is also the focus of this thesis, are one of the important steps taken to disseminate energy efficiency projects and encourage large-scale projects by overcoming the difficulties of reducing the risk on the customer's side and providing financing on the projects carried out by energy service companies. The energy performance contract is defined in Energy Efficiency Law No. 5627 as "a contract based on the principle of guaranteeing the energy savings to be achieved after the implementation project and paying the expenditures with the savings that will occur as a result of the implementation." In other words, the energy service company becomes a partner in the project risk by guaranteeing a certain energy-saving to its customer at the beginning of the project.
