Ab Entegre Kirlilik Önleme Ve Kontrolü Direktifi (ıppc) İçin Düzenleyici Etki Analizi Ve Bir Uygulama: Demir Çelik Endüstrisi

Özet
Bu çalışma, Avrupa Birliği Entegre Kirlilik Önleme ve Kontrolü Direktifi (96/61/EC)’nin kamu kuruluşlarına ve sanayiye getirdiği mali yükümlülüklerin, gelişmiş ülkelerde ekonomik etkinliğin ve toplumsal refahın arttırılmasına yönelik olarak uygulanmakta olan “Düzenleyici Etki Analizi” (DEA) kavramı ile ele alınmasının gerekliliğini vurgulamayı amaçlamaktadır. Düzenleyici Etki Analizinin, uygulandığı birçok ülkenin düzenleme sürecine önemli katkılar sağladığı görülmektedir. DEA, özellikle AB mevzuatına uyum sağlamakla yükümlü aday ülkelerin düzenleme sürecine katkıda bulunmaktadır. Düzenlemelerin etkilerinin değerlendirilmesine yönelik sistematik bir yöntem Türkiye’de henüz etkin olarak uygulanmamaktadır. Bu sebeple bu çalışmada, Entegre Kirlilik Önleme ve Kontrolü Direktifinin Düzenleyici Etki Analizine yönelik olarak Türkiye için bir yol haritası oluşturulmaya çalışılmıştır. Sürecin sanayi işletmeleri ve sektörel dernekler tarafından gerçekleştirilecek İşletme ve Sektörel Etki Analizleri ile güçlendirilmesi gerektiği vurgulanmıştır. Mevcut En İyi Teknikler’e ulaşmak için yapılacak yatırımın işletmenin rekabet gücünü etkilemeyecek bir sürede planlanmasına yönelik bir metodoloji geliştirilmiştir. Bu kapsamda demir çelik üretimi yapan bir tesiste yapılan uygulama çalışması ile tesisin Direktife uyum durumu Mevcut En İyi Teknikler açısından incelenmiş ve bir aralık analizi yapılmıştır. Bu çalışmaya ek olarak Demir Çelik Üreticileri Derneği yetkililerinin katkıları ile direktifin yürürlüğe girmesi ile sektörün rekabet gücünün olumsuz etkilenmemesi ve en kısa zamanda uyum sağlaması için sektörün bütününe dönük bir SWOT analizi çalışması gerçekleştirilmiş ve bir eylem planı önerisi oluşturulmuştur.
This study aims to highlight the importance of assessing the economic impacts of Euroean Union Integrated Pollution Prevention and Control Directive on the industrial sectors and the public institutions by the help of “Regulatory Impact Analysis” (RIA) which is used to increase economic effectiveness and social welfare in developed countries. RIA contributes to regulatory period in the applied countries and especially to the countries that are in integration period with the EU. There is no comprehensive and systematic method used to assess the impacts of regulations effectively in Turkey. Therefore, a roadmap is suggested for Regulatory Impact Analysis to be used as a tool to assess Integrated Pollution Prevention and Control Directive’s economic impacts in Turkey. Business and Sectoral Impact Analysis should be managed by the enterprises and sectoral associations to strengthen the implementation period. In this perspective an iron and steel producing facility is examined to determine its state of compliance with the Best Available Technologies (BAT) by a gap analysis. A methodology is produced to plan the amount of investment that should be done by an enterprise to reach the BAT level without affecting its competitiveness. Additionally, a SWOT analysis is prepared for the iron and steel sector with the help of Turkish Iron and Steel Producers Association’s competents’ contributions. This analysis highlights the different aspects for this industrial sector in complying with the directive without its competitiveness being affected negatively and in minimum amount of time. An action plan is formed to be suggested in this perspecitive.
