İstanbul’da Bir Kentleşme İmkanı Olarak Yasal-yasadışı Karşılaşmalar: Gökkafes (süzer Plaza)

Özet
Kentleşme, uluslararası kentlerin varlığı ile yüzyıla damgasını vuracak önemli konular arasındadır. Sınırları ve ülkeleri tanımayan büyük metropoller birbirleriyle sürekli bir iletişim içerisinde olmakla birlikte aynı zamanda da yarış halindedirler. İşte bu kentlerden bir tanesi olan içinde yaşadığımız İstanbul’da bu kentleşme trendlerine ayak uydurmuş ve her geçen gün çehresini hızla değiştirmektedir.  Bu dev kentler sivrilme yarışı içerisinde kendine has özellikleriyle öne çıkmakta ya da geride kalmaktadır. Zamana ayak uydurmak adına hızlı çıkışlar yapma ihtiyacında olan metropoller geçmişleri ve altyapılarına yaslanarak geleceğe uzanmaya çalışmaktadır. Ancak yarış içindeki tüm kentleri aynı süreçler içerisinden geçiyormuş gibi varsayamayız. Tarihsel geçmişinin ve altyapısının daha planlı olduğunu söyleyebileceğimiz batı kentleri bu hızlı dönüşüm süreçlerini daha güçlü göğüslemektedir denebilir. Geç modernleşmiş ülkelerdeki kentler için ise durum aynı değildir. Zaten kentleşme deneyimini baştan beri oldukça hızlı yaşayan bu kentler bu yarışın içine büyük altyapı problemleri ile girmiştir. Problemli kentsel örüntüler üzerine hızlıca yenilerini örmek ise gelecekte karşımıza bambaşka görüngüler olarak çıkacaktır. İstanbul da işte bu ikinci gruba daha çok uyan bir kenttir. Yeni kentsel politikalar ile birlikte karmaşık ve bir o kadar da hızlı ilerleyen bir sürecin içinde olan kent pek çok problem ve beraberinde dinamik barındırmaktadır. Bu alan mimarlık akademiyası için sınırsız bir araştırma alanıdır. Ancak bu günkü kentleşme eğilimlerini anlayabilmek ve sorunlara çözüm arayışlarına girebilmek için İstanbul’a özgü kentleşme dinamiklerini bakmak gerekir.  İstanbul’un kendine özgü kentleşmesini anlayabilmek için bütünsel bir araştırmadansa belirli bir noktaya odaklanmış eleştirel bir çalışma yapmak gerekir. Bu tür çalışmalarda kentsel kırılmalarda önemli yer teşkil eden bir istisnai durum kentin çok önemli bir karakteristiğini ortaya çıkarır. Bu karakteristik ise kent hakkında derinlemesine fikir edinmede yardımcı olur. Bu çalışma için bu istisnai durum yasal-yasadışı karşılaşmalardır. İstanbul kentsel arenada tüm yasal ve yasadışı yapıların; hatta bazen hem yasal hem de yasadışı unsurları içinde barındıran yapıların birarada barındığı bir oluştur. Tüm imar yasaları ve imar planlarının varlığına içinde barındırdığı yasadışı unsurlarıyla istisna özelliğini taşıyan bu yapılaşma eğilimi toplumun her tabakasının başvurduğu bir yöntem olarak sahneye çıkmaktadır. Çok büyük yatırım projelerinden, gecekondulara, hastanelerden, konutlara kadar neredeyse tüm yapılar bazen tamamıyla bazen de sadece bazı kısımlarıyla yasadışı yöntemlere başvurmaktadır. Bu yasadışı yöntemlerle yapılan inşai faliyetlerin daha sonra yönetim tarafından gerek imar aflarıyla gerekse yeni yönetmeliklerle yasal hale gelmesi ise sürecin kanıksanmasında etkin rol oynamaktadır. Bu yasal ve yasadışı süreçlerden geçen yapıların içinde kaldıkları bu oluşa yasal-yasadışı karşılaşmalar tanımı getirilmektedir. Bu oluş yasalar tarafından tanımlanamaz ve kapsanamaz olduğu için istisnai özelliğini korurken, toplumun çoğunluğu tarafından kullanılır hale gelmesi istisnanın kuraldan nasıl daha kurucu hale gelebildiğini gözler önüne sermektedir. Nitekim ufak bir literatür taramasıyla bu türden yapılaşmaların İstanbul kentleşmesinde nasıl büyük bir yer teşkil ettiği anlaşılmaktadır. Yasal-yasadışı karşılaşmaları ortaya çıkarmak için çalışma iki şekilde yürütülmüştür. Birinci yöntem kavramsal ve tarihsel çalışmalar, ikinci yöntem ise alan çalışmasıdır. Kavramsal çalışmalarda yasal-yasadışı karşılaşmaların çerçevesi çizilmiş ve tarihsel okumada ortaya çıkarılması için bazı yardımcı kavramlar öne çıkarılmıştır. Bu kavramların yardımıyla 1980 sonrası kentsel yönetim mekanizmalarına ve aktörlere yoğunlaşılmıştır. Bu kavramsal ortaya koyuşun bir örneklemesi olarak Dolmabahçe 2 No’lu parktaki benzer süreçlerden geçmiş yapılar hızlıca gözden geçirilmiş ve yine bu yapılardan biri olan Gökkafes yapısı tüm imar süreçleri, aktörleri ve topluma yansıma biçimleriyle derinlemesine irdelenmiştir.
Urbanization is one of the most important incidents in our age. It marks the century because of the existence of the international cities. These cities almost do not recognize borders and states. Their interrelation exceeds the capabilities of one administrational organization of the state. They are in relation and in competition with each other. For example, first problem of traffic jam is reported to city hall during the Byzantine times. This problem still continues and in fact one of the most important problems of our time. Now, is it possible to define Istanbul as only a city of Turkey? It has a historical aspect that goes beyond the limits of Turkey vertically in time. Istanbul also has agreements and relations with other big cities of the world or with international associations. As a result, Istanbul is one of these grand metropolises and keeps up with this urbanization trend. We can realize it in everyday life. We live in it and day by day our awareness of change on its appearance increases.  These giant cities, in the competitions of urbanization either distinguish from others with their unique aspects or fall behind. Metropolises are in need of taking rapid and courageous steps with the purpose of keeping up with the modern-age. These metropolises, to be able to take these steps, try to reach to the future by taking the support of their past and infrastructure. However, we should not assume immediately all cities that are in competition with each other experience equal processes. Every city has their own cultural history and infrastructure. So, their development and urbanization processes will be different as well depending on these differences. For example, western cities have more deliberated and planned past and infrastructure as compared with the rest of the old world. Because of that history, it is possible to suggest, Western cities’ reception of rapid transformation processes of the new age became more salutary and ordered. Their reflection toward these innovations became more planned. One major reason for this difference is that, they were the actors of these transformations to a certain extent. However, in countries whose modernization occurs in a later period, situation is quite the contrary. These cities experience an accelerated version of urbanization processes. Therefore, they participate in the urbanization competition with big infrastructure problems. In addition, to build new structural patterns without planning on a basis of already a pattern of problematic city reflects further and greater problematic phenomenon in the long term. Istanbul is a city that fits mostly to the latter group of metropolises. Istanbul is in a complicated and rapid process of urbanization especially after the establishment of new municipal policies. Therefore, Istanbul carries many potencies that possible to result as both problems and dynamics within. These potencies constitute an unlimited field of study for academicians of Architect. If we want to comprehend inclinations of urbanization in today’s Istanbul and find a solution these problems, we should examine and inquire the urbanization dynamics indigenous to Istanbul that embedded in history.  A holistic inquiry would be insufficient for comprehending the idiosyncratic urbanization of Istanbul. So, one should carry one-step further and conduct a critical survey by focusing on a specific aspect. In these kinds of studies, an exceptional case that constitutes an important place in breaking points of urbanization processes reveal an important characteristic feature of cities. This characteristic feature helps us prefigure thoroughly on the city itself. By borrowing the concept of exception from Schmidt, we try reveal de facto circumstances in Istanbul. Exception is what builds the law by excluding itself from it. Possibility of the military coup in states of emergency is actually the limit of law. Existence of a hegemonic entity over the law carries the potentia of removing it. Transformation of potentia to energia transcends the law. So, what defines the law is exception. The exceptional case for this study is legal-illegal confrontations. İstanbul has a form that hosts both of legal and illegal structures in the municipal arena. Istanbul includes these opposite structures all together. Sometimes, it is even possible to see both of these legal and illegal patterns in one structure. In Istanbul, there is a tendency of construction that carries exceptional aspects of illegal elements to the area of legal boundaries, development plan law and development plan implementation. This tendency occurs as a method conducted by all layers of society. It is possible to see this picturesque tendency in many cases, great projects of investment, shanty houses, hospitals, housing estates etc... It is almost like a custom to conduct illegal methods sometimes for the entire structure and sometimes for one part of it. In addition, it is not unusual to see that these constructional activities conducted with illegal methods are forgiven and immunized because of new regulations in construction plan. These regulations and exemptions play an important role in inurement of the process. We define the formation includes structures that process both of legal and illegal methods, as legal-illegal confrontations. This formation cannot be defined and compromised by laws. Therefore, they preserve their exceptional feature. However, they are also conducted by most of the people. This situation reveals the fact that exception is able to become more constituent and hegemonic than the law. Hence, it is easy to see how big these kinds of constructions occupy in Istanbul, by a bit of study of second literature. This study is conducted with respect to two methods to reveal the legal-illegal confrontations. First method is conceptual and historical survey, and the second is field survey. In the conceptual part, it is tried to form a frame for legal-illegal confrontations. In addition, some supporter concepts are put forward for easing of understanding these confrontations in their historical existence. With the help of these concepts, we focused on municipal administration mechanisms and actors that existed after 1980s. We took a peek to the constructions that experience similar processes in Dolmabahçe Park No 2 as an exemplification of these concepts. After that, we concentrated on Gökkafes, which is one of these constructions in Dolmabahçe Park No 2, and scrutinized it in its entirety, meaning processes of planning, improvement, actors, and its ways of reflection in the society. Urbanization is one of the most important cases of our age and Istanbul is one of the most interesting metropolises. A study of Istanbul with respect to its development historically does not show us just processes unique to Istanbul. We may also find some similarities in development and urbanization of Istanbul with other non-Western cities. Not only similarities but also differences are beneficial for us. Differences are as important as similarities for those who are dealing with comparative studies. A major theory seems almost impossible for non-Western cities now. However, an accurate comprehension in development and urbanization of non-western cities would be possible only if these minor studies that are focusing on specific cases increases. Every little step will help us take the big one.
